United States Attorney Brendan V. Johnson announced that a Mission woman charged with conspiracy to distribute and possess with intent to distribute methamphetamine by a federal grand jury was sentenced on September 6, 2011, by United States District Judge Roberto A. Lange. Arlene Love Siers, age 22, was sentenced to 37 months of custody, three years of supervised release, and a $100 special assessment to the Victim Assistance Fund.

Siers was indicted for conspiracy to distribute and possess with intent to distribute a controlled substance on March 8, 2011. She pled guilty to the charge on June 20, 2011. Arlene Love Siers was a middle woman who assisted two suppliers in distributing methamphetamine on the Rosebud Reservation. The two men lived in Nebraska and transported methamphetamine to South Dakota. They provided methamphetamine to Siers, who re-distributed it to her contacts in the Mission area. The two suppliers traveled to Rosebud two times a month between February of 2009 and April of 2010. They would front Siers three grams of methamphetamine at a time. Siers would sell the three grams of methamphetamine and come back for three more grams to sell. She sold approximately nine grams of methamphetamine each time her supplier came. Siers sold a total of between 2 and 4½ ounces of methamphetamine, and half a pound (226.8 grams) of marijuana in 2009.

About 8:48 PM Wednesday night, Deputies responded to a report of a Home Invasion and Shooting at a residence located on Corn Mill Road in the Mayo community. Upon arrival Deputies and Investigators learned that three men had come to the residence and attempted to gain entry into the home by forcing their way through a window. The homeowner and two women inside the home knew the three men and told them to leave the property. The men refused and continued to try and gain entry into the home. The homeowner, who was in fear of his safety and the safety of the other two occupants of the house, retrieved a shotgun and shot one of the men in the lower leg. At this time the three men ceased any further attempts to force entry into the home. The individual that was shot, Steven McCoy LeGrande, Gaffney, SC, was transported to Spartanburg Regional Medical Center for treatment of a non-life threatening gunshot wound. Mr. LeGrande and the two other men, Jordan
Nathaniel Ray Derosia, Gaffney, SC and Andrew Scott Reed Savage, Gaffney, SC have been charged with one count each of Burglary 1st Degree. Mr. Derosia and Mr. Savage have been arrested and are currently in the Spartanburg County Sheriff’s Office Detention Center awaiting a bond hearing. Mr. LeGrande is still in the hospital recovering from his wound. Upon his release from the hospital he will be transported to the detention center. The homeowner, Mr. Jeremy Keith Lowe, will not face any charges related to the shooting of Mr. LeGrande. The investigation of the case revealed that Mr. LeGrande and the other two men had come to the residence because Mr. LeGrande was upset with Mr. Lowe over a disagreement involving a woman.

Larry Bernhard, age 55, a podiatrist who operated his business from his home in Gambrills, Maryland, pleaded guilty to health care fraud and aggravated identity theft related to a scheme to fraudulently bill Medicare for more than $1.1 million. The guilty plea was announced by United States Attorney for the District of Maryland Rod J. Rosenstein; Special Agent in Charge Nicholas DiGiulio, Office of Investigations, Office of Inspector General of the Department of Health and Human Services; and Special Agent in Charge Richard A. McFeely of the Federal Bureau of Investigation.

“Health insurance programs trust providers to bill honestly for medical services, so it is essential to punish doctors who betray that trust,” said U.S. Attorney Rod J. Rosenstein. “Dr. Larry Bernhard flagrantly ripped off Medicare Advantage by fabricating claims for services that he never provided, collecting more than $1 million in new false claims even after he was caught and prohibited from billing federal health care programs.”

According to Bernhard’s plea agreement, since 1981 he has been a licensed podiatrist in Maryland and operated a podiatry practice under the business name, Chesapeake Wound Care Center. Bernhard ran the Chesapeake Wound Care Center business from his home. On October 30, 2007, Bernhard entered into a Settlement Agreement with the government to resolve allegations that from April 1, 2002 through October 11, 2004, Bernhard submitted 80 claims to Medicare for podiatry services purportedly provided at skilled nursing facilities when, in fact, the patients were actually in hospitals at the time the services were allegedly provided. As part of the settlement Bernhard agreed to be excluded from “Medicare, Medicaid, and all other Federal health care programs” for a period of three years.

Bernhard admits that from October 31, 2007 to July 20, 2010, he fraudulently billed Medicare Advantage plans and was paid at least $1.1 million from these plans. All of the fraudulent billing occurred while Bernhard was excluded from billing all federal health care programs, including Medicare Advantage plans. Of the $1.1 million received by Bernhard, at least $1 million was for services that were not rendered. Bernhard admits that he used the names and personal identifying information of approximately 200 patients at various nursing homes to submit false bills for podiatry care that he never performed.

Bernhard faces a maximum penalty of 10 years in prison for health care fraud and a mandatory two years in prison, consecutive to any other sentence imposed, for aggravated identity theft. U.S. District Judge James K. Bredar has scheduled sentencing for November 21, 2011 at 10:00 a.m. As part of his plea agreement, Bernhard has agreed to pay restitution of $1,122,992.08.

Fulton County Detention Officers BRIAN SHELBY ANTHONY, 30, of Atlanta, Georgia; AKIL SCOTT, 31, of Atlanta, Georgia; and DERICK DESHUN FRAZIER, 31, of Morrow, Georgia; and Fulton County Deputy Sheriff MARVIE TREVINO DINGLE, Jr., 34, of Lithonia, Georgia, have been charged with extortion for their roles in accepting payments to deliver contraband to inmates inside the Fulton County Jail.

ANTHONY; DINGLE; AQEEL MUHSIN RASHEED, 27, of Atlanta, Georgia; KEITHAN HENRI JAMES, 33, of Decatur, Georgia; and ROBERT LEE SWAIN, Jr., 29, of Snellville, Georgia, were indicted on charges of attempted possession with intent to distribute cocaine outside the jail. Another defendant, RAYFIELD LEWIS II, 32, of Union City, Georgia, was arrested pursuant to a criminal complaint on charges of attempted possession with intent to distribute cocaine outside the jail. The defendants are making their initial appearances late today and tomorrow before United States Magistrate Judge Janet F. King. United States Attorney Sally Quillian Yates said, “As law enforcement officers employed at the Fulton County Jail, these men took an oath to serve and protect the public. Instead, they abandoned their oaths and sold their badges by taking payoffs to smuggling contraband to jail inmates and facilitate illegal drug deals on the outside. We are committed to vigorously prosecuting corrupt law enforcement officers who betray the public and their fellow law enforcement officers.”

Brian D. Lamkin, Special Agent in Charge, FBI Atlanta, said, “The indictments and arrests announced today are the culmination of an intensive federal investigation that involved many hours of hard work by not only our agents but also our law enforcement partners, to include Fulton County Sheriff Ted Jackson. Those that choose to abdicate their oaths of office can do great harm. The greatest harm, however, is that to the public trust, which makes the work of the rest of the criminal justice community even more difficult.

On Tuesday, May 17, 50 persons who were wanted on family court bench warrants that were issued after the persons did not make a combined total of $435,467 in court-ordered child support payments in Lexington County turned themselves in during Operation Last Chance. The Lexington County Sheriff’s Department and Lexington County Clerk of Court’s Office conducted the child support enforcement effort at the Marc H. Westbrook Lexington County Judicial Center.
Lexington County Sheriff James R. Metts and Lexington County Clerk of Court Beth Carrigg implemented Operation Last Chance in order to give persons one final opportunity to amicably resolve family court bench warrants that were issued for their arrests after the persons did not make court-ordered child support payments in Lexington County.
A total of 53 family court bench warrants were resolved as a result of Operation Last Chance, Metts and Carrigg said.
Family court judges resolved 47 family court bench warrants by implementing payment plans for unpaid, court-ordered child support payments in Lexington County, Metts and Carrigg said. Judges ordered six habitual offenders who turned themselves in on family court bench warrants to be jailed at the Lexington County Detention Center. One of the six habitual offenders later made a child support payment and was released from the Detention Center on Tuesday.
“This was a very successful day because we helped many children in Lexington County,” Metts said. “The men and women of the Sheriff’s Department are dedicated to improving the quality of life for all people in Lexington County.”
“Sheriff Metts and I are more dedicated than ever in today’s tough economic times to obtain financial support for children and parents who have custody of children,” Carrigg said. “Dead-beat parents will not be tolerated in Lexington County, and we will use every legal means available to provide children and parents who have custody of children with the financial support that they deserve and need.”
